Rights and Permissions

It’s hard to imagine a duller subject for a Gazette than rights and permission, but in fact this is an important matter for our Club. We do not post pictures on our website unless we have permission from either the owner of the item or the photographer to use the picture. I am not going to write a treatise on copyright law. However, putting a picture on the website is considered publication, and you cannot publish someone else’s work without their permission.

This is especially important when we deal with museums. We have good working relationships with Corning, Inc., the Corning Museum of Glass, the Rockwell Museum of Western Art, the Rakow Library, many auction houses and many collectors because they know that the Club respects their rights and obtains permission before using pictures of any of their glass.

When pictures are submitted to Marshall Ketchum, our Webmaster, one of the questions he asks is whether the pictures are of pieces that you own. If not, he asks whether you had the right to take the picture and have the right to provide it to the Club.

We protect our rights and those of our picture contributors by posting the following copyright notice on every picture in the database : “This information is provided by the Carder Steuben Club, Inc. for individual personal use only. All rights are reserved. No use of the images and photographs on this site is authorized without the express written consent of the Carder Steuben Club, Inc.”

If you have pictures of pieces that you own that are not already pictured on the website, please submit them to Marshall.

BACKGROUND ON OBTAINING PICTURES FOR THE WEBSITE–NOW OVER 10,000

Only a very small percentage of photos are actually submitted and when they are it is usually obvious that the person submitting just got the piece and has taken a photo. If I know the individual, asking if the piece or photo is their property is usually unnecessary.

The majority, perhaps 95% of the photos, that I add are those that I find by hunting through ebay and various live auctions. When I find something that we need I capture the photo to make sure that it looks presentable and then ask the ebay seller or the auction house if I may post one of their photos. I will always include the URL of our site so the seller can see how the photo is going to be used.

I have only been refused by one ebay seller and two auction houses that insist that their names be credited on the photo which we, as a matter of Club policy, will not do. A photo will not be posted until I get a positive response from the seller.

2013 Carder Steuben Club annual Symposium will be held at The Corning Museum of Glass in Corning, NY from September 19-21, 2013. The festivities will begin with Frederick Carder’s 150th birthday celebration on the evening of September 18, 2013.
